TERMS AND CONDITIONS:
This is an Agreement between Embrace Your Extraordinary (“Host”) and its owners Jodie Ross and Deidre Dattoli (“Coaches/Owners”) in their capacity as Coaches and Owners of Embrace Your Extraordinary, and the Customer/Participant (“You”) for the Awaken Your Dreams Practical Transformation Toolkit (“A.Y.D Toolkit”).

Embrace Your Extraordinary provides individuals with well-being/health and self-leadership coaching, education, practices, strategies, and support to help them leverage their own inner wisdom, and align with their extraordinary true nature, in order to improve their well-being, energy, and life outcomes. This will be delivered through the content, tools and practices included in the A.Y.D Toolkit designed for self-paced engagement by the Customer/Participant throughout the Term of this Agreement.

Execution: By agreeing to these Terms and Conditions (“Terms”) and completing your purchase for the A.Y.D Toolkit to which these Terms apply, You are executing a legally binding Agreement with Embrace Your Extraordinary and its Coaches/Owners, and are agreeing in full to the following Terms in their entirety:
 

1. TERM:
The Terms of this Agreement apply to Customer/Participant purchase and ongoing access to the A.Y.D Toolkit, a self-paced digital product made available at the time of Customer/Participant purchase. With the exception of Sections 1 through 15, which shall survive the Term of this Agreement.

 

2. BOOKING CONFIRMATION, PAYMENT AND FEES:  
By purchasing the A.Y.D Toolkit through the Embrace Your Extraordinary website(s) or checkout payment link, You agree to pay the full amount of the purchase price listed at the time of transaction for your selected payment option at checkout. 

Your access to the A.Y.D Toolkit will be confirmed upon successful payment in full or establishment of a pay-over-time payment plan, along with the completion of the successful checkout and registration process. 

By submitting your order, agreeing to these Terms, and authorising the payment charges using your chosen payment method, You acknowledge that You have read and understood the Terms and Conditions (“Terms”) of use, Privacy Policy, and any legal documentation provided by the Payment Gateway Providers. You agree to be legally bound to the following Terms:

Payments:
You acknowledge and agree that You authorise Kajabi and Stripe Payment Integration (“The Payment Gateway Providers”), to charge the selected payment amount for your selected payment option through Stripe on behalf of Embrace Your Extraordinary today. 

You acknowledge and agree that the credit card(s) or payment method(s) You are using to make this purchase will be active, valid and have sufficient funds available for this payment during the entire term of the payment period. If for any reason your payment is declined, You will provide an alternative, valid payment method promptly. 

You understand that You are legally bound to these Terms and required by law to make all payments on the agreed-upon payment dates. 

You agree to make all payments via The Payment Gateway Providers by the due date for your respective payment option. Payments can be made by using debit card and credit card through The Payment Gateway Providers.

All sales are final for this digital product and must be paid in full according to the payment option selected by You at checkout. Upon execution of this Agreement and Terms, You agree to pay Embrace Your Extraordinary the full purchase amount for the A.Y.D Toolkit as per Terms in accordance with your selected payment option chosen at checkout for one of the following payment options: 

Payment Options:
a) One-Time Payment: 1 x $498 AUD payment. Access to the A.Y.D Toolkit is granted immediately upon successful payment.

OR

b) Pay Over Time Payment Option – 2 Payments: 2 x equal monthly payment instalments of $264 AUD (Total $528 AUD). You will be charged $264 AUD on the date of the first purchase, followed by a second and final payment instalment of $264 AUD one month later. Access to the A.Y.D Toolkit is granted immediately upon successful first payment.

OR

c) Pay Over Time Payment Option – 8 Payments: 8 x equal weekly payment instalments of $68.50 AUD (Total $548 AUD). You will be charged $68.50 AUD on the date of the first purchase, followed by seven further weekly payment instalments of $68.50 AUD each week for seven consecutive weeks. Access to the A.Y.D Toolkit is granted immediately upon successful first payment.

If You choose a pay over-time payment option, You are committing to complete all remaining payment instalments after your initial payment, on the scheduled due dates as per agreed Terms. You authorise The Payment Gateway Providers to charge your chosen payment method for each instalment amount on the agreed dates. You acknowledge that You are not subscribing to a membership and You are not able to cancel the purchase, or your payment obligations, within the payment period. 

Failed Payments:
If any payment fails, You agree to resolve the issue immediately by updating your payment information, providing an alternate payment method, and/or making any missed payments. Failure to do so will cause access to the A.Y.D Toolkit to be temporarily paused until successful outstanding payments are completed within a three-week period. In the occurrence of failed payments, The Payment Gateway Providers with their Smart Retry, will reattempt to retry payments up to four times over a three-week period. If payment remains unresolved after three weeks, Customer/Participant access to the A.Y.D Toolkit will be cancelled.

You agree that if You default on any payments due and payable under these Terms, any costs incurred by Embrace Your Extraordinary for steps taken to enforce payment Terms will be recoverable and payable by You. 

In the event that any payment under these Terms is not made in full as agreed upon, Embrace Your Extraordinary reserves the right to send Customer/Participant to collections for any outstanding monies due and owed under the Terms of this Agreement. 

Embrace Your Extraordinary reserves the right to report delinquent payments to credit agencies and collections agencies.  

 

3. REFUNDS AND CANCELLATION POLICY:
a) Due to the nature of digital content, all sales for the A.Y.D Toolkit are final. No refunds will be issued if You change your mind, do not engage with the content, or choose to cancel for any reason after purchase.

b) Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli, are not liable for any loss, perceived value, or outcomes arising from your decision not to use or complete the A.Y.D Toolkit content.

c) In the rare case that Embrace Your Extraordinary needs to withdraw access to the A.Y.D Toolkit for unforeseen reasons, Embrace Your Extraordinary reserves the right to provide access to an equivalent or improved version of the content, or offer an appropriate credit toward a future program. Refunds may be offered at Embrace Your Extraordinary and its Coaches/Owners discretion in these exceptional circumstances.

d) As this is a digital product delivered upon purchase, the A.Y.D Toolkit access is non-transferable. Sharing login details or distributing the A.Y.D Toolkit content to others is strictly prohibited under the Terms of this Agreement.

 

4. CONFIDENTIALITY: 
Agreement to these Terms constitutes a Mutual Non-Disclosure Agreement between Embrace Your Extraordinary and its Coaches/Owners, and You.

Both parties agree not to disclose, share, reproduce, or distribute any confidential information, personal insights, or proprietary content obtained through access to the A.Y.D Toolkit. This includes but is not limited to: teaching frameworks, methods, guided practices, proprietary language, coaching strategies, and participant reflections or discussions (if applicable).

You agree to treat all A.Y.D Toolkit content as confidential and for personal use only. This content may not be reproduced, shared, or taught to others without prior written consent from Embrace Your Extraordinary.

This confidentiality agreement remains in effect during and after your access to the A.Y.D Toolkit and is designed to protect the intellectual property, methods, and integrity of the work shared through the A.Y.D Toolkit.

5. DISCLAIMER: 
The content of all products and information offered by Embrace Your Extraordinary or any of its representatives, Coaches/Owners, and their website, are for educational and informational purposes only. The content is not medical advice and should not be used for the diagnosis or treatment of any medical condition. No guarantees of results are made. If You are currently being treated by a physician or other healthcare practitioner, or have been diagnosed with any condition, please consult with that provider prior to taking part in any practice. You understand this A.Y.D Toolkit is designed by Embrace Your Extraordinary for educational and informational purposes only, with the intention of supporting You in learning self-empowerment and personal growth strategies, energy awareness practices, and well-being tools that may contribute positively to your self-development and quality of living.

You also understand that Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli are not Medical Doctors or licensed mental health professionals. They do not diagnose, treat, or cure medical physical, psychological, or emotional conditions, nor do they provide medical advice or recommendations for medical treatment for any condition. You understand and agree that it is 100% your responsibility to consult with the appropriate health care provider if seeking medical advice or supervision and You remain 100% responsible for your own health, safety, well-being, personal, business, and life decisions, choices, results, and outcomes at all times. 

You accept sole responsibility for your own health, safety, well-being, personal, professional, career, business, personal development, self-empowerment, physical, mental and emotional health and well-being, and any personal or business life decisions, choices, results, or outcomes – personal and professional — made both during and after your engagement with the A.Y.D Toolkit. You acknowledge that your progress, outcomes and results are entirely dependent on your own effort, integration, and 100% personal responsibility.

You understand, accept, and agree that results are not guaranteed by Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli. You agree that your use and engagement with the A.Y.D Toolkit, including any and all of your results and outcomes are 100% at your own risk, discretion and responsibility.

You agree to indemnify and release Embrace Your Extraordinary and its Coaches/Owners, Jodie Ross and Deidre Dattoli from any and all liability associated with your use or misuse of the A.Y.D Toolkit content, including but not limited to any physical, emotional, mental, health, financial, personal or business decisions, actions, inactions, results, life outcomes and consequences.

6. PRODUCT SPECIFICS:
The A.Y.D Toolkit is a self-paced, digital empowerment resource offered by Embrace Your Extraordinary through the Kajabi Platform, that includes guided education, energy and mindset practices, reflection exercises, and downloadable tools designed to support your personal empowerment, transformation and alignment with your dreams, goals, and heart’s desires. Upon your agreement of the payment Terms and successful purchase of the A.Y.D Toolkit, You receive your personal login details to access the A.Y.D Toolkit.

You acknowledge and agree that You are solely responsible for your outcomes achieved either by your participation or non-participation in any and all of the A.Y.D Toolkit content. You acknowledge and agree that your outcomes are dependent on your own participation, commitment, and integration of any and all of the A.Y.D Toolkit content. Embrace Your Extraordinary makes no guarantees of results. You acknowledge and agree that You are 100% responsible for your progress, outcomes, and the benefits You may or may not receive through your engagement with the A.Y.D Toolkit.

7. PRODUCT CHANGES:
Embrace Your Extraordinary reserves the right to update, change, modify, or enhance the content of the A.Y.D Toolkit at any time in order to improve its value and effectiveness. This may include but is not limited to changes or revisions to practices, structure, format, or delivery. You will be notified in the event of any major changes that significantly alter the A.Y.D Toolkit access or experience.

8. EMBRACE YOUR EXTRAORDINARY COMMITMENT AND RESPONSIBILITIES:
Embrace Your Extraordinary agrees to deliver access to the A.Y.D Toolkit as outlined in Section 6: Product Specifics and 7: Product Changes, and as described on the official Embrace Your Extraordinary website(s) and checkout at the time of the Customer/Participant purchase of the A.Y.D Toolkit.

This includes providing access to all A.Y.D Toolkit materials, downloadable resources, and guided content in alignment with the program description, for the duration of the A.Y.D Toolkit's lifetime, as outlined below:

A.Y.D Toolkit Access, Content Updates, and Upgrades:

a) Customer/Participant access to the A.Y.D Toolkit is granted upon initial purchase and in accordance with the agreed payment Terms. 

b) Full payment must be received according to the agreed payment Terms in order for Customer/Participant to maintain continuous access to any and all A.Y.D. Toolkit content. If payment Terms or Terms of any kind are not met as agreed, Customer/Participant access to the A.Y.D Toolkit will be temporarily paused until outstanding payments are completed within a three-week period. If payment remains unresolved after three weeks, Customer/Participant access to the A.Y.D Toolkit will be cancelled as outlined in Section 2: Booking Confirmation, Payments and Fees ‘Failed Payments’ of these Terms.

c) Providing all Terms are met, Customer/Participant purchase of the A.Y.D Toolkit offers Customer/Participant lifetime access to the A.Y.D Toolkit.

d) Customer/Participant lifetime access to the A.Y.D Toolkit includes all content available at the time of purchase, as well as any future content updates, enhancements, or upgrades provided.

e) Embrace Your Extraordinary reserves the right to update, change, modify, or enhance the A.Y.D Toolkit content at any time, at the discretion of the Coaches/Owners in alignment with the continued growth and refinement of the program.

f) Lifetime access to the A.Y.D Toolkit refers to Customer/Participant access to the A.Y.D Toolkit for the lifetime of the A.Y.D Toolkit itself. This means access is provided for as long as the A.Y.D Toolkit is maintained, supported, and made available online by Embrace Your Extraordinary. Embrace Your Extraordinary reserves the right to determine the duration of the A.Y.D Toolkit’s availability and may retire or phase out the A.Y.D Toolkit at its discretion.

9. CUSTOMER COMMITMENT AND RESPONSIBILITIES: 
The A.Y.D Toolkit has been created for educational and inspirational purposes, to support You in reconnecting with and leveraging your own inner wisdom, and enhancing your self-empowerment, personal growth, alignment, and well-being.

By accepting the Terms of this Agreement, You accept and agree that Embrace Your Extraordinary does not guarantee You any specific outcomes or results. Your experience, and any and all results or outcomes You create or achieve throughout and beyond your use of the A.Y.D. Toolkit, are 100% solely dependent on the effort, intention, and integration You bring to your engagement with the A.Y.D. Toolkit.

You acknowledge that You accept full 100% responsibility for any and all of your progress, participation, safety, results, decisions and outcomes 100% of the time throughout and beyond your use of the A.Y.D. Toolkit as outlined in Section 5. Disclaimer, and this Section 9. Customer Commitment and Responsibilities of these Terms.

By purchasing the A.Y.D. Toolkit and executing these Terms, You agree to the following: 

a) You are of sound mind and body to purchase and engage with the A.Y.D. Toolkit, and You take 100% responsibility for your health, safety, well-being, personal, professional, business, personal development, self-empowerment, life decisions, choices, results, and outcomes at all times during and after engaging with the A.Y.D. Toolkit.

b) Your registration and participation does not breach any law of your own country or region.

c) You are 18 years or over and have authority to agree to these Terms.

d) The information You provide during registration is true and accurate, and You agree to keep your contact and payment information up to date.

e) You will not use any username or display name or identity that is false or likely to mislead or deceive Embrace Your Extraordinary, its Coaches/Owners, or other participants.

f) You are purchasing the A.Y.D Toolkit access for yourself only and will not share your access or registration details with anyone else without the prior written permission from Embrace Your Extraordinary.

g) You will not transfer, gift or resell your access to the A.Y.D Toolkit to any third party, without the prior written permission from Embrace Your Extraordinary.
 
h) You will notify Embrace Your Extraordinary immediately if You believe that any A.Y.D Toolkit digital files, links or access points provided contain technical issues such as viruses, spyware or other forms of malware. 

i) You agree that You will engage with the A.Y.D Toolkit, Embrace Your Extraordinary, its Coaches/Owners, and any other parties involved with the A.Y.D Toolkit with respect and lawful manner, and You will not, through any means: Harm, harass, hassle or abuse any parties. Send un-welcomed communication such as spam to any parties. Act in an unlawful, abusive, defamatory, discriminatory or otherwise objectionable manner. Disclose or share any confidential or personally identifiable information in relation to any party without consent. Infringe the intellectual property or privacy rights of any party, or any third-party, with relation to all parties involved with the A.Y.D Toolkit.

10. NON-DISCLOSURE, CONFIDENTIALITY, INTELLECTUAL PROPERTY, LIMITED LICENSE and NON-DISPARAGEMENT:
Agreement to these Terms is considered a Mutual Non-disclosure Agreement. 

Confidential Information & Non-Disclosure:
Embrace Your Extraordinary takes pride in the proprietary information included in this A.Y.D Toolkit. “Confidential Information” includes, but is not limited to: 

Embrace Your Extraordinary to Customer:
Embrace Your Extraordinary respects Customer/Participant privacy and will only use your personal information for the purpose of facilitating access to the A.Y.D Toolkit and for communications via their email list. Embrace Your Extraordinary will not share Customer/Participant personal information with third parties without Customer/Participant consent.

Embrace Your Extraordinary agrees to protect Customer/Participant confidential information, shared by You. Embrace Your Extraordinary will not use or disclose, directly or indirectly, any Confidential Information shared by Customer/Participant during the period of the A.Y.D Toolkit, and indefinitely thereafter.  Exceptions – The provisions of the section above will not prohibit any disclosure that is required by law or court order, or if Embrace Your Extraordinary is concerned about Customer/Participant safety. In the event of such a situation, the Customer/Participant is given reasonable prior notice and opportunity to contest or minimise such disclosure. 

Customer to Embrace Your Extraordinary:
Customer/Participant agrees and acknowledges all Confidential Information shared throughout the A.Y.D Toolkit by Embrace Your Extraordinary and its Coaches/Owners is confidential, proprietary, and belongs exclusively to Embrace Your Extraordinary. “Confidential Information” includes, but is not limited to:

a) Any systems, techniques, sequences, processes or guided practices provided in the A.Y.D Toolkit.

b) Any information disclosed in association with these Agreement Terms.

c) Any trade secrets in connection with the A.Y.D Toolkit or Embrace Your Extraordinary business practices. 

Testimonials:
Embrace Your Extraordinary agrees to protect Customer/Participant confidential and personally identifiable information. However, Embrace Your Extraordinary may use general statements or screen shots from Customer/Participant messages about Customer/Participant success or feedback, as social proof and part of its marketing strategy. By agreeing to the Terms, You agree for Embrace Your Extraordinary to share your Customer/Participant success stories or feedback in any matter as testimonials on the Embrace Your Extraordinary website(s) and/or social media or marketing materials. Embrace Your Extraordinary agrees to only ever include a Customer/Participant full name on any testimonial shared only if Customer/Participant has given consent. 

Non-Disparagement: 
Customer/Participant agrees, during and/or after your use of the A.Y.D Toolkit, You will refrain from making any public or private statements, whether oral or in writing, that negatively impact Embrace Your Extraordinary or its Coaches/Owners Jodie Ross and Deidre Dattoli, the A.Y.D Toolkit, Business, Services, Products, or Reputation. 

11. INTELLECTUAL PROPERTY & LIMITED LICENCE: 
Intellectual Property:
This A.Y.D Toolkit and the related content shall be considered intellectual property owned by Embrace Your Extraordinary. This Agreement is intellectual property owned by Embrace Your Extraordinary. Other examples of intellectual property found on Embrace Your Extraordinary website(s) and within their products and services include, but are not limited to: trademarks, services, layout, logos, business name, design, text, written copy, certain images, podcasts, recordings, videos, audio files, and all of the paid products (collectively referred to as “Intellectual Property”). Customer/Participant shall not copy, publish, transmit, transfer, sell, create derivative works from, reproduce, or in any way exploit any of the Intellectual Property owned by Embrace Your Extraordinary described within this Section in either whole or part without prior written consent from Embrace Your Extraordinary. 

Limited License:
Embrace Your Extraordinary grants only a limited, personal, non-exclusive and non-transferable license to Customer/Participant to use the Intellectual Property for Customer/Participant personal use. Nothing in this Agreement and Terms shall transfer ownership of or rights to any intellectual property of Embrace Your Extraordinary to the Customer/Participant, nor grant any right or license other than those stated in this Agreement and Terms. Customer/Participant acknowledges and agrees that their purchase of this A.Y.D Toolkit is for their single individual use. Customer/Participant acknowledges and agrees that any and all products or services accessed in this A.Y.D Toolkit and/or Embrace Your Extraordinary resources are for their own personal use. Customer/Participant shall not copy, reproduce, transmit, modify, edit, create derivative works from, alter, sell, or share with others any products or parts of the A.Y.D Toolkit without prior written consent from Embrace Your Extraordinary. If the Customer/Participant is also a business owner in a similar industry, Customer/Participant must not copy or reproduce the A.Y.D Toolkit material, publish, sell or teach any of the Embrace Your Extraordinary intellectual property and proprietary information, pass it off as their own or in any way exploit any of the Intellectual Property owned by Embrace Your Extraordinary in either whole or part without prior written consent from Embrace Your Extraordinary.

12. RELEASE OF LIABILITY AND INDEMNITY:
You hereby agree to take 100% responsibility for your own health, safety, well-being, personal, professional, business, personal development, self-empowerment, life decisions, choices, results, and outcomes at all times during and after engaging with the A.Y.D Toolkit. You acknowledge that Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli are not liable for any health, safety, well-being, personal, professional, business, personal development, self-empowerment, life decisions, choices, results, and outcomes, injuries or losses that may arise from any of your Customer/Participant life choices – personal and professional – You make before, during or after your purchase and participation in the A.Y.D Toolkit. You indemnify Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli from any liability regarding said decisions, choices, results and outcomes. You hereby agree to indemnify and hold Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli harmless of any claims that may arise during or after your participation in the A.Y.D Toolkit.

By agreeing to the Terms of the A.Y.D Toolkit, You release, waive, discharge, and agree not to bring any form of legal action against Embrace Your Extraordinary and its Coaches/Owners Jodie Ross and Deidre Dattoli in connection with any cause of action stemming from your access to, or use of the A.Y.D Toolkit or related services. 

13. FORCE MAJEURE:
If circumstances beyond the control of Embrace Your Extraordinary prevent or hinder its provision of the A.Y.D Toolkit, Embrace Your Extraordinary is free from any obligation to provide the A.Y.D Toolkit while those circumstances continue. Embrace Your Extraordinary may elect to terminate these Terms or keep these Terms on hold until such circumstances have ceased. Circumstances beyond the control of Embrace Your Extraordinary include, but are not limited to: unavailability of materials or components, pandemics, strikes, lockouts, riots, natural disasters, fire, war, acts of God, Government decrees, proclamations or orders, transport difficulties and failures or malfunctions of computers or other information technology systems. Embrace Your Extraordinary may suspend the provision of the A.Y.D Toolkit in part or in whole to You indefinitely and will not be liable for any losses or damage due to such scenarios.  

14. GOVERNING LAW:
The laws of Victoria, Australia govern these Terms. 

15. MISCELLANEOUS: 
a) Entire Agreement – This Terms Agreement reflects the entire Agreement of Terms between the parties. This Agreement trumps any other existing negotiations, communications, or Agreements between the parties, whether written, oral, or electronic, and is the full extent of the Agreement between the parties. 

b) All Rights Reserved – All rights not expressly granted in this Terms Agreement are reserved by Embrace Your Extraordinary.

c) Arbitration – Any disputes arising under this Terms Agreement shall first be resolved through a binding arbitration. 

d) Maximum Damages – Customer/Participant agrees and acknowledges that the maximum amount of damages that Customer/Participant may be entitled to in any claim arising from this Agreement and Terms shall not exceed the total cost of purchase for the A.Y.D Toolkit.

e) Execution – Customer/Participant agrees to accept the Terms of this Agreement in its entirety when Customer/Participant purchases the A.Y.D Toolkit and acknowledges this Agreement and Terms by checking the checkbox, “I have read and agree to the terms and conditions of this page as follows:” at the checkout.

f) You, and Embrace Your Extraordinary and its Coaches/Owners confirm and acknowledge that these Terms, the A.Y.D Toolkit, the A.Y.D Toolkit Checkout Purchase Page, and all A.Y.D Toolkit Content or Information Pages of the Embrace Your Extraordinary Website(s) constitute the entire Terms and Agreement between You and Embrace Your Extraordinary, and shall supersede and override all previous communications, either oral or written, between the parties. 

g) You acknowledge and agree that your payment, and any and all engagement with the Embrace Your Extraordinary A.Y.D Toolkit is agreeing in full to the Terms of this Agreement in their entirety.
